Scope
These Terms and Conditions apply to all contracts between Peter Fauland (hereinafter “Photographer”) and his clients regarding photographic services, workshops, and the creation and licensing of image material.
Clients within the meaning of these Terms include both consumers and businesses.Conclusion of Contract
A contract is formed upon acceptance of an offer (in writing or via email) or by booking a workshop.
Individual agreements take precedence over these Terms.Services
The Photographer provides the agreed services independently and at his own artistic discretion. This includes, in particular, image composition, perspective, selection, and post-processing.
The Photographer is entitled to engage qualified third parties (subcontractors) to fulfill the contract but remains responsible for the proper execution of the services.Copyright and Usage Rights
Copyright of all created images remains with the Photographer.
The client is granted a non-exclusive usage right within the scope agreed upon in the contract. Unless otherwise agreed:
Private clients: use for personal purposes only.
Business clients: use within the agreed commercial scope (e.g. website, advertising, social media).
Any additional use (e.g. transfer to third parties, resale, publication beyond the agreed scope) requires written consent.
Usage rights are transferred only after full payment has been made.
In case of violations, the Photographer is entitled to prohibit usage and claim appropriate additional licensing fees and damages.
5.Fees and Payment
All prices are in euros, plus applicable VAT where required.
The Photographer is entitled to request a deposit of up to 50%.
The remaining balance is due within 14 days of invoicing.
In the event of late payment, statutory default interest pursuant to § 288 BGB applies.
Until full payment is received, all usage rights remain with the Photographer.
6. Cancellation and Rescheduling
Photo and video assignments:
Cancellation up to 72 hours before the appointment: free of charge
72 to 24 hours before: 50% of the agreed fee
Less than 24 hours or no-show: 100%
Workshops:
Cancellation up to 3 days before: free of charge
Thereafter: 50% of the participation fee
No-show: full fee
The client may provide a substitute participant.
Services already rendered must be paid in full.
7. Workshops – Execution
The Photographer reserves the right to reschedule workshops in case of insufficient participants, illness, or unsuitable conditions (e.g. weather).
An alternative date will be offered.
If the client cannot attend the alternative date, the participation fee will be refunded.
8.Client Responsibilities
The client is responsible for ensuring that all necessary permissions, access rights, and approvals required for the assignment are obtained in advance.
Delays or additional effort caused by missing cooperation may be charged separately.
9. Liability
The Photographer is liable for damages only in cases of intent or gross negligence.
The Photographer is only liable for loss of data or image material if standard data backup measures were not taken.
No liability is accepted for circumstances beyond the Photographer’s control (e.g. weather, technical failure despite proper maintenance), unless caused by gross negligence.
10. Use of Images by the Photographer
The Photographer is entitled to use the created material for self-promotion (portfolio, website, social media, exhibitions).
The client may object to this use at any time.
11. Data Protection
Personal data is processed exclusively in accordance with applicable data protection laws.

12. Final Provisions
The law of the Federal Republic of Germany applies.
Should any provision of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
